1. Acceptance of Terms

Welcome to Vision Labs mobile applications (FaceCast, Visio, Shutter AI, and any other apps developed by Vision Labs Yazılım Hizmetleri A.Ş.). By accessing or using our applications, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our applications.

2. Description of Service

Vision Labs provides AI-powered mobile applications offering various creative and productivity features, including but not limited to AI-powered photo editing, generation, enhancement, transformation, and other innovative features we may introduce from time to time.

3. In-App Purchases and Subscriptions

Certain features require payment through in-app purchases or subscriptions. All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions.

• Subscriptions automatically renew unless canceled at least 24 hours before the current period ends
• Manage subscriptions through your App Store or Google Play account settings
• All sales are final. No refunds are provided for unused subscription periods, early cancellations, or unused credits
• Deleting the app or your account does not cancel subscriptions
• Payment processing, refunds, and disputes are handled exclusively by Apple or Google

4. User Content and License

When you use our services:

• You retain ownership of your original content
• You grant Vision Labs a non-exclusive, worldwide license to use, process, store, and display your content as necessary to provide and improve our services
• You grant us the right to use your content for service development, AI model training, and quality improvement purposes
• You represent that you own or have obtained all necessary rights to the content you upload
• You are responsible for your content and ensuring it complies with applicable laws

5. Acceptable Use

You agree not to:

• Violate any applicable laws or regulations
• Upload illegal, harmful, or inappropriate content
• Infringe upon others' intellectual property rights
• Attempt to circumvent security measures or access restrictions
• Interfere with the proper functioning of our services

6. AI-Generated Content

Our AI services generate creative outputs based on your inputs. You understand and agree that:

• AI results are computational predictions and approximations
• Results are provided "as is" without guarantees of accuracy or suitability for any particular purpose
• AI-generated content is for personal entertainment and creative use
• You are responsible for how you use AI-generated outputs

7. Intellectual Property

All intellectual property rights in our applications, including software, algorithms, UI designs, branding, and AI models, belong to Vision Labs. These are protected by copyright, trademark, and other intellectual property laws.

8. Privacy and Data

Your use of our applications is also governed by our Privacy Policy. We collect and use data as described in our Privacy Policy to provide, improve, and personalize our services.

9. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, ERROR-FREE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISION LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF OUR SERVICES.

11. Indemnification

You agree to indemnify and hold harmless Vision Labs, its affiliates, and personnel from any claims, damages, losses, and expenses (including legal fees) arising from your use of our services, your content, or your violation of these terms.

12. Changes to Terms

We may modify these terms at any time. Continued use of our services after changes constitutes acceptance of the modified terms.

13. Termination

We may suspend or terminate your access to our services at any time, with or without notice, for any reason including violation of these terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ankara, Turkey.
